Commission Process & Agreement
1. General Terms
These Terms of Service (the "Terms") govern the relationship between Richard T Davis Illustration & Custom Art (the "Artist") and you (the "Client") regarding custom illustration and art commission services. By commissioning work from the Artist, you agree to be bound by these Terms.
2. Quotes & Payment
All projects begin with an agreed-upon quote. A 50% non-refundable deposit is required to commence work. The remaining 50% balance is due upon completion of the artwork and must be received before the final delivery of digital files or physical artwork. Payments are accepted via PayPal or bank transfer. Non-payment of the final balance will result in the withholding of the final artwork.
3. Revision Process
To ensure your complete satisfaction, one round of minor revisions is included at the sketch phase. Any significant changes or additional rounds of revisions beyond the initial included round will be billed at an hourly rate of $75.00 USD. Clear communication during the sketch approval phase is crucial to minimize additional costs.
4. Copyright & Usage
The Artist retains all copyrights to commissioned artwork, regardless of the client or project type. For personal commissions (e.g., family portraits, nursery art), the Client is granted personal usage rights, meaning you can display, print, and share the artwork for non-commercial purposes. The Artist retains the right to display the artwork in portfolios, websites, social media, and promotional materials. For commercial work (e.g., children's book illustration, product design), specific usage rights and licensing terms will be outlined in a separate, detailed commercial contract or agreement. Commercial usage rights directly affect the project's pricing.
5. Cancellation Policy
Should the Client choose to cancel a commission after the project has begun, the initial 50% non-refundable deposit will be forfeited. If, for unforeseen circumstances, the Artist must cancel a commission, a full refund of any payments made will be issued to the Client within 7 business days.
6. Delivery
Final artwork, once the full payment is received, will be delivered as a high-resolution digital file (e.g., JPEG, PNG, TIFF) suitable for printing or digital display, as per the agreed-upon project specifications. Physical artwork will be shipped via a tracked and insured service, with shipping costs added to the final invoice.
